1.  Welcome to ColdKonnect, the premier platform connecting cold storage owners with potential customers. These Terms and Conditions (“Terms”) serve as the foundation for your interactions and activities within the App.
2. By accessing, registering, or using the App, you are committing to uphold and be bound by these Terms. Should you find any clause disagreeable, please refrain from any further interaction or activity within the App.

Definitions

1. “Users” encompasses both the cold storage owners listing their facilities and customers seeking storage opportunities.
2. “Listings” comprise all details pertaining to cold storage spaces, including but not limited to, size, temperature, location, cost, and available dates.
3. “Booking” is the affirmative action of reserving specific cold storage space, subject to the conditions set by the storage owner and these Terms.

Registration and Account Management

1. A user account is a pre-requisite to unlock full access to features, ensuring a personalized and secure experience.
2. During the registration phase, users are mandated to present accurate, complete, and current information. Any discrepancies discovered may result in restricted access or account suspension.
3.  Maintaining the confidentiality of account credentials is the sole responsibility of the user. Any unauthorized access or suspicions thereof must be promptly reported to ColdKonnect.

Listings

1. Owners must ensure all listings uphold accuracy and adhere to ethical standards, portraying their spaces without misrepresentation.
2. All listed spaces are expected to comply with local and national regulatory standards. ColdKonnect may, at its discretion, request verification or validation documentation.
3. ColdKonnect exercises the right to review, modify, or remove listings that appear misleading, false, or not in alignment with our community standards.

Payments

1.  For safeguarding user financial data, ColdKonnect collaborates with renowned third-party payment gateways, ensuring every transaction’s security.
2. Payment terms are majorly at the discretion of the storage owner but should remain within ColdKonnect’s acceptable range and guidelines.
3. All financial obligations, including taxes, levies, or dues arising from app usage, are solely the responsibility of the user, particularly the storage owner.

Cancellations, Refunds, and Disputes

1. Each booking is bound by a cancellation policy, explicitly defined by the storage owner but mandatorily in line with ColdKonnect’s minimum requirements.
2. ColdKonnect ensures a structured and transparent refund procedure. However, the initiation of refunds is strictly in accordance with the set cancellation policy.
3. While ColdKonnect provides a platform for mediation in the event of disputes, the final responsibility for resolution rests between the disputing parties.

User Conduct

1. Ethical, respectful, and legal behavior is non-negotiable. Any activities or engagements in violation of this ethos are subject to punitive measures.
2. All attempts to compromise the platform’s integrity, including data mining, unauthorized data extraction, or malware introduction, will result in immediate action, which may include legal recourse.

Ratings and Reviews

1. Constructive feedback fosters growth. Users are encouraged to leave reviews reflecting genuine experiences. Sensationalism, defamation, or unwarranted negativity may be moderated.
2. While owners have a right of response to reviews, ColdKonnect expects the dialogue to remain civil, constructive, and professional.

Data Protection and Privacy

1. Every user’s privacy is sacrosanct. Our dedicated Privacy Policy elaborates on data collection, usage, and protection mechanisms.
2. While ColdKonnect employs cutting-edge data security technologies, the evolving nature of cyber threats means we cannot guarantee invulnerability.

Liability and Insurance

1. ColdKonnect’s primary role is as an intermediary. As such, direct dealings, agreements, or conflicts between parties are beyond our liability scope.
2. Assessing and understanding any insurance coverage associated with a listed space is a critical responsibility for users, especially those booking storage space.

Modifications to Terms

1. The digital landscape is ever-evolving. Consequently, we periodically review and revise our Terms to stay current. We’ll make every effort to inform users of significant shifts.

Governing Law

These Terms, in their entirety, are drawn, interpreted, and executed in deference to Indian Law. Disputes, if unsolvable through mediation, will be adjudicated in Hyderabad Court.

Termination

1. Repeated or severe violations of these Terms may lead to restrictions, suspension, or permanent account termination.
2. Users retain the right to account deletion, understanding that ColdKonnect may, per our Privacy Policy, retain select data.

Indemnification

Users undertake to shield ColdKonnect against any claims, damages, losses, or legal actions stemming from violations of these Terms or any third-party rights.

Disclaimer

ColdKonnect offers services “as-is” and “as available”, eschewing all explicit or implied warranties, including the implied warranties of merchantability, non-infringement, and fitness for a particular purpose.
